Patrick Names Aloisi

Governor Deval Patrick picked long time insider James Aloisi as his Secretary of Transportation today. Patrick made the announcement on a Friday afternoon when most everyone is concerned about the big storm bearing down on us and there are few folks in Boston. Do you think the Governor wanted to downplay the big announcement? The State House News Service is reporting that Aloisi has received over $350,000 in pension payments already since his “retirement” from the Turnpike Authority in 1996. His benefit, which started at $2231 per month is now up to $2552 per month, over $30,000 annually. Attorney Aloisi will be the leader of the Governor’s efforts to reform transportation. The Governor’s press release is below.

Moving forward in his efforts to reform the state’s transportation system, Governor Deval Patrick today announced the appointment of James A. Aloisi, Jr. as Secretary of the Executive Office of Transportation and Public Works (EOT).
Aloisi is an expert in transportation law and he has a long and distinguished career in public service with the Commonwealth. As Transportation Secretary, Aloisi will lead EOT and serve as chair of the governing boards of the Massachusetts Turnpike Authority and Massachusetts Bay Transportation Authority (MBTA). He will also continue to serve as a member of the Massport board of directors.

“Jim brings a deep understanding of the challenges we face in reforming our transportation network,” said Governor Patrick. “He will be a skilled and energetic advocate for our reform agenda.”

The announcement comes as the Patrick Administration has a unique opportunity to work with the legislature to bring comprehensive reform over a relatively short amount of time. Governor Patrick believes Aloisi will start working with legislative leaders and the transportation community immediately, in order to deliver on Governor Patrick’s vision for a safe and efficient statewide transit system.

Aloisi will work closely with Transportation Undersecretary Jeffrey Mullan and other key transit officials on reform initiatives, while continuing the administration’s efforts to identify savings and efficiencies to ensure money from taxes, tolls and fares is spent wisely and effectively. One of EOT’s top priorities in the New Year will be to file and work toward the passage of a comprehensive transportation reform bill, which includes dismantling the Massachusetts Turnpike Authority and continuing to invest in transportation infrastructure.

These reforms will build on the groundwork laid out by the Patrick Administration including implementing the first ever Mobility Compact to coordinate the state’s transportation network, identifying tens of millions of dollars in cost-savings across agencies and making critical capital infrastructure investments.

“In these challenging times, my task will be to keep faith with Governor Patrick’s vision to bring the Commonwealth’s transportation system into a new era. In collaboration with the Legislature, Jeff Mullan and other key transportation officials, we will inaugurate a new model of consolidation, creativity and forward-looking thinking,” Aloisi said. “We will do so in a way that is fair to all of our transportation users – everyone from the riders on Regional Transit and MBTA buses, to commuters on MBTA subways and trains, to the motorists using our highways and bridges, and the travelers using our airports. I am convinced that we can adopt a comprehensive solution that eliminates outdated barriers to reform, and that is respectful of the dedicated men and women who drive those buses, maintain those trains and roads, and operate those airports.”

Aloisi is a Director at Goulston & Storrs, a graduate of Boston College Law School and holds a Master in Liberal Arts (History) from Harvard University. Aloisi previously served as Assistant Secretary of the Executive Office Transportation, Assistant Attorney General, Chief Legal Counsel for the Massachusetts Department of Revenue, and General Counsel for the Massachusetts Turnpike Authority. Most recently, he served on the board of the Massachusetts Port Authority.

Aloisi will take on his new role next month, succeeding Secretary Bernard Cohen, who resigned effective January 2, 2009.

“I thank Bernard for his successful efforts to move forward with transportation reform and bring a renewed spirit of collaboration among our transportation agencies,” said Governor Patrick. “He leaves a great model of partnership for Jim and the rest of us to follow.”

Franken Surges into lead

The sub-title of this post is “Jules Gordon’s nightmare”, as Al Franken has stormed into the lead in the Minnesota recount. There is still plenty of activity left, and no decision is yet apparent, but Franken has not led this fight until today. If you thought Jules was despondent after the Obama victory you have not seen anything yet. From MSNBC:

Democrat Al Franken edged ahead of Republican incumbent Norm Coleman on Friday for the first time in Minnesota’s long-running U.S. Senate recount.

Franken opened up a slight lead on the fourth day of a state Canvassing Board meeting to decide the fate of hundreds of disputed ballots.

The change was notable because Coleman led Franken in election night returns and also held a 188-vote lead before the board took up challenged ballots. But its significance was limited, with the possibility the lead could change again before the long recount ends.

Bush Statement on Auto Bailout

President Bush this morning announced an auto bailout plan that will have the federal government provide over $13 billion dollars in loans to the US Big Three. The companies will be required to restructure, but will have one year to make adjustments in labor costs. From the Washington Post:

The troubled U.S. auto industry will receive emergency loans of $13.4 billion from the federal government in return for an extensive restructuring of its outstanding debt and labor costs over the coming year, according to administration officials.

Funds for the loans will come from the Troubled Asset Relief Program initially set up to aid the financial industry. An additional four billion will be available in February.

But the money will come with some extensive strings attached. Though the White House will not appoint a “car czar” to oversee the industry going forward, the companies will have to restructure their wage agreements so that they are competitive with foreign automakers by the end of next year. In addition, by March 31 of this year the companies will have to show they are financially viable and able to repay the government — a requirement that may, for example, force them to renegotiate outstanding debt and other agreements.

If the automakers are able to inflict the necessary medicine on their operations this deal will be in the best interests of the country. If they cannot manage to make their operations as lean as possible then we will have only bought them some time.

Methuen Public Schools to Release Students Early

Methuen public schools, due to the oncoming storm, will release students early today, Friday December 19. The High School will be released at 10:45 a.m., Upper School at 11:15 a.m., and Lower School at 11:45 a.m.

Admiral Dennis Blair will be the new D.N.I.

NBC News is reporting that Dennis Blair will be named tommorow as the new Director of National Intelligence. From NBC:

Sources involved in President-elect Obama’s transition confirm that former Admiral Dennis Blair has been selected as the new Director of National Intelligence.

A 34-year Navy veteran, Blair was commander of the U.S. military’s Pacific Command, was director of the Joint Staff, but also worked with the CIA and National Security Council.

Blair, a Rhodes Scholar and Russian speaker is considered a “brainiac” who has experience in managing large organizations. A commander of Pacific Command he’s known for pushing political and diplomatic engagement over military confrontation.

NBC is also reporting that Hilda Solis will be named Labor Secretary and former Dallas Mayor Ron Kirk will be named as the Trade Representative.

Richard Vitale Indicted

The accountant to and campaign treasurer of Speaker Sal Dimasi has been indicted by Attorney General Martha Coakley on charges related to lobbying activity and illegal campaign contributions. From the Boston Globe:

Richard Vitale is accused of secretly pushing legislation on behalf of the ticket brokers, which included directly lobbying DiMasi and House Speaker Pro Tempore Thomas Petrolati on several occasions. In one instance, Vitale forwarded e-mails from the ticket brokers to a personal e-mail address of DiMasi, according to a press release issued by the office of Attorney General Martha Coakley. Investigators also allege that Vitale used a courier service to deliver printed copies of e-mails from the ticket brokers to Petrolati’s office.

“Investigators found that on at least one occasion, Vitale delivered an e-mail which requested specific changes to the bill, which the House of Representatives made before passing the bill,” the press release says.

The indictment is a blow to Speaker Dimasi, and comes on the heels of the convening of a federal grand jury to look at some of these same issues. The full text of the press release by Attorney General Martha Coakley is below.

Attorney General Martha Coakley Announces 10 Grand Jury Indictments Against Richard Vitale for Lobbying and Campaign Finance Violations
BOSTON – Today, as part of an ongoing investigation, a Suffolk County Grand Jury returned 10 indictments against Richard Vitale and WN Advisors, LLC, an entity owned and controlled by him, for violations of state lobbying and campaign finance laws. Vitale, age 63, of Boston, is charged with failing to file timely registration statements for 2007 and 2008 (2 counts), making an illegal agreement for compensation contingent on the passage of legislation (1 count), and making campaign contributions in excess of the $200 maximum per year for legislative agents (4 counts). WN Advisors is charged with failing to file timely registration statements in 2007 and 2008 (2 counts) and making an illegal agreement for compensation contingent on the passage of legislation (1 count).
After a referral by the Secretary of State’s Office in June 2008, the Attorney General’s Office began an investigation of potential lobbying law violations by Vitale and WN Advisors. WN Advisors was paid a total of $60,000 by the Massachusetts Association of Ticket Brokers (“MATB”). MATB hired Vitale and his firm to promote legislation regulating the resale of tickets to sporting and other entertainment events. In October 2007, the Massachusetts House of Representatives passed ticket resale legislation; the bill did not, however, pass the Senate.

Under state law, a person “who for compensation or reward does any act to promote, oppose or influence legislation” is considered a “legislative agent” who must file an annual registration statement with the Secretary of State’s Office and pay a filing fee. Legislative agents must also file detailed, itemized reports twice a year listing all campaign contributions, lobbyist expenditures, and all bill numbers of legislation that they acted to promote or influence. An entity that employs legislative agents must also file annual registration statements, file semi-annual detailed reports and pay a filing fee. All of this information is then made available to the public on the Secretary of State’s website.

During the course of the investigation, authorities discovered that Vitale communicated directly with two of the highest-ranking members of the House of Representatives, Speaker Salvatore DiMasi and Speaker Pro Tempore Thomas Petrolati, on multiple occasions in an attempt to promote ticket resale legislation on behalf of MATB. Investigators found that Vitale arranged for and attended meetings with those Representatives and a member of MATB, and that Vitale also allegedly met privately with the Representatives to discuss proposed legislation. In addition, investigators learned that Vitale used a courier service on multiple occasions to deliver printed copies of emails from the representative of MATB to Representative Petrolati’s office and Vitale also allegedly forwarded emails from the representative of the MATB to a personal email address of Speaker DiMasi. Specifically, investigators found that on at least one occasion, Vitale delivered an email which requested specific changes to the bill, which the House of Representatives made before passing the bill.

Investigators found that Vitale deliberately concealed his role in promoting legislation by arranging for meetings with the Representatives in his accounting firm office and other private locations. Authorities learned that on at least one occasion, Vitale specifically instructed a member of MATB not to disclose the role of WN Advisors.

Vitale and WN Advisors failed to file registration statements for 2007, and they filed untimely registration statements for 2008 in May 2008 only after being instructed to do so by the Secretary of State.

Investigators also discovered that Vitale signed an agreement on behalf of WN Advisors with MATB that included a provision that WN Advisors would receive additional compensation ($20,000) upon the final passage of favorable ticket resale legislation. Massachusetts law prohibits any person from making an agreement for compensation that is contingent upon the passage or defeat of legislation.

During the time period that Vitale allegedly actively promoted legislation and WN Advisors received payments from MATB, Vitale made four separate campaign contributions to state legislators in excess of $200. Massachusetts law prohibits legislative agents from contributing more than $200 per year to any elected official’s campaign committee.

The maximum penalty for failure to make required lobbyist filings and for making illegal contingent compensation agreements is $5,000. Thus, Vitale and WN Advisors face a combined total of up to $30,000 in fines if convicted on all counts involving those provisions. The maximum penalty for making campaign contributions in excess of the limit for lobbyists is imprisonment for not more than six months or a fine of $500. Therefore, Vitale faces up to two years imprisonment or additional fines of up to $2,000 if convicted on all four campaign finance counts.

The Grand Jury returned the indictments this afternoon. Vitale will be summonsed to Suffolk Superior Court for arraignment on January 5, 2009.

Officials from the Secretary of State’s Office, the Inspector General’s Office, the State Ethics Commission, and the Office of Campaign and Political Finance assisted with this investigation. Vitale, Caturano & Co., Ltd., the accounting firm that formerly employed Vitale, also cooperated with the Attorney General’s Office. Vitale is no longer affiliated with the firm.
